Gilchrist on Bargaining for Trials

Gregory M. Gilchrist (University of Toledo College of Law) has posted Counsel's Role in Bargaining for Trials (Iowa Law Review, Forthcoming) on SSRN. Here is the abstract:

This essay examines how counsel might use plea bargaining to mitigate the harm of plea bargaining: rather than bargaining only for pleas, counsel should bargain for trials. Plea bargaining defines our criminal justice system and counsel’s role in most criminal cases.
