Martin & Newhall on Prosecutions of Filesharing Services

Benton C. Martin and Jeremiah Robert Newhall (Emory University School of Law and Independent) have posted Guidelines to Limit Criminal Prosecutions of Filesharing Services (30 Santa Clara Computer and High Technology Law Journal 2013) on SSRN. Here is the abstract:

This short essay acknowledges certain efficiencies in enforcing copyright law against "secondary" infringers like filesharing services through criminal proceedings, but it proposes guidelines for prosecutors to use in limiting prosecutions against this type of infringer.
