Cert dismissed in case alleging trial delay resulted from state's failure to fund defense counsel

The Court dismissed the writ as improvidently granted in a per curiam order in Boyer v. Louisiana. Justice Alito, joined by Justices Scalia and Thomas, filed a concurring opinion arguing that the delay in the case was not attributable to the facts alleged in the petition for certiorari. Justice Sotomayor filed a dissenting opinion, joined by Justices Ginsburg, Breyer, and Sotomayor.
