"A Justice's Curious Comment About ABA Guidelines For Death Penalty Lawyers"

That's the title of the post at BLT reporting on Justice Alito's concurring opinion this week in Bobby v. Van Hook, in which the Court reversed the Sixth Circuit's conclusion that a criminal defendant had received ineffective assistance of counsel. Justice Alito wrote separately to emphasize that the ABA's guidelines for appointment and performance of counsel in capital cases should not be given undue weight.
