Burford Abstention
In a recent case, Judge Garaufis declined to abstain under the Burford abstention doctrine, concluding that deciding the federal suit would not "disrupt New York's effort to establish a coherent eminent-domain policy." Goldstein v. Pataki, 2007 WL 1654009 (E.D.N.Y., June 6, 2007).
