San Fernando Valley Bar Association
Dear All:
The San Fernando Valley Bar Association is at it again. Its Business/Bankruptcy/Real Property section is presenting four brief topics of interest to bankruptcy practitioners. Louis Esbin and Steven R. Fox are the speakers. They will present brief topics of interest to bankruptcy attorneys and, as is usual, attendees will add to the presentations. The program is set for Wednesday, June 8th at 12:00 noon. The program will conclude by 1:15 p.m. to allow attorneys to attend hearings at the Woodland Hills Bankruptcy Court two blocks away.
The four topics are:
1. Individual Discharge in Chapter 11 Case Prior to Plan Payments Being Completed. One of the speakers recently obtained an early discharge. The brief (it covers the issues and cites cases) will be given out to attendees.
2. The Means Test. Going beyond the software with some neat ideas. Bring your own ideas as well.
3. When Attorneys Are Held Liable for Errors in the Petition and Schedules. This is a minefield for attorneys with new penalties under BAPCPA.
4. Exemption Planning Under the Dark Light of BAPCPA. Attorney Louis Esbin, who has spent a lot of time with exemption issues will be addressing this issue.
If time permits, the speakers will also discuss the absolute priority rule for individuals in chapter 11 and the ongoing split in case law. If you do chapter 11 work, this is a new (and real) problem.
The speakers are well experienced. Even better, the audience is typically filled with experienced bankruptcy attorneys who make valuable contributions to the program. I encourage you to attend and to also sign up any associates you have.

46th Annual Seminar NATIONAL ASSOCIATION OF CHAPTER 13 TRUSTEES
The 46th Annual NACTT Seminar will be held August 3rd-6th, 2011, in Anaheim, California. Join
us to experience “Riding the Incoming Wave of Chapter 13.”
The annual seminar will officially begin on Thursday morning, August 4, 2011.
Judge RogermEfremsky will lead a distinguished panel that will review the Ransom
and Lanning cases and an examination of the subsequent fallout from their holdings.
Dean Erwin Chemerinsky will join with Judge Barry Russell and our own Rick Fink for
a Supreme Court review examining where we have been and where we are going. The
afternoon will feature panels of interest to practitioners,trustees and trustees’
staff. We are especially pleased to feature Michael Roake, who will present
two sessions devoted to trial skills for the novice or the proficient. Current hot
topics related to securitization and assignments will be examined. Modification and
income issues will also be examined. The staff attorneys have devised a track for
Thursday afternoon to examine issues that they confront every day. The day will
conclude with the elegant President’s Reception.
On Friday, August 5, 2011, our panelists will examine ethical issues surfacing from
social networking and its effect on us in the bankruptcy arena. Our second panel of
the morning will examine demographic issues. Friday afternoon will be open for
everyone to enjoy everything that beautiful southern California has to offer.
On Saturday morning, August 6, 2011, we will have the annual Case Law Update
presented by Judge Lundin, Judge Brown and Chapter 13 Trustee Henry Hildebrand.

May 18, 2011: The Pre-Workout Agreement: What It Is, Why You Want It, What’s in It
Program Information:
Some of the most serious lender liability problems arise in connection with a
lender’s actions and statements that are made in the course of a loan workout
and restructuring negotiation. Lenders may find themselves subject to a breach
of contract based on a borrower’s allegations that the lender orally agreed to
restructure the loan or orally waived a breach, and then reneged on such an
agreement or waiver.
A Pre-Workout Agreement can help mitigate these risks. This program will
discuss when to get the Pre-Workout Agreement and what it should contain.
This program will also cover commercial loan workout strategies and pre-bankruptcy
planning from the perspective of a secured commercial lender.

FINANCIAL LAWYERS CONFERENCE Chapter 11 Cases for Individuals An Uneasy Amalgam of Chapter 11 and Chapter 13
Due to the economic downturn, entrepreneurs have resorted and will continue to resort to chapter 11 to deal with illiquid assets and significant business debts in order to remain in control of their property and avoid wholesale liquidation. These debtors and their counsel and creditors will find themselves in an oddly different legal world, created by BAPCPA’s introduction of many structures and concepts from chapter 13 into chapter 11 cases for individuals.
This program will help you identify and overcome new challenges to navigating this “brave new world” successfully. For example:

What is “projected disposable income” and why do I have to know?

American Bankruptcy Institute -- Bankruptcy Battleground West Conference

In its 19th year, ABI’s Bankruptcy Battleground West continues the tradition of bringing
seasoned insolvency professionals together to discuss, debate and learn about leading
issues of bankruptcy law.
This year’s program addresses some of the most intriguing issues that have emerged
during the latest insolvency cycle, including California’s municipal financial
troubles, challenges facing insolvent real estate enterprises and the latestlegal
developments in chapter 11 plan confirmation proceedings.

practitioners in our field, and a keynote speech by Professor Kenneth N. Klee of the
