EU Competition Law Procedure

Ingrid Vandenborre (Skadden) and Thorsten Goetz (Skadden) discuss EU Competition Law Procedure.
ABSTRACT: Over the past twelve months, there have been a number of important European Court judgments addressing various aspects of EU competition law procedure, including the standard of judicial review, the probative value of corporate statements, and access to European Commission documents pursuant to Regulation 1049/2001. Other developments include the publication of the Commission's antitrust manual of procedure, as part of an increased focus on transparency in EU competition law procedures. This same focus has also led to an increasing role for the European Ombudsman in competition law procedures supplementing the role of the Hearing Officer and that of the courts.
