Jonathan Zuck (Association for Competitive Technology argues for Procedural Fairness.

ABSTRACT: In a recent speech, Neelie Kroes of the European Commission argued that “as enforcers we do have ‘special responsibility’ to ensure a fair and transparent process. But the great weight of evidence says we meet this responsibility.” While the Commission clearly has made some efforts to meet its “special responsibility,” there is also evidence to suggest more can—and should—be done.
