Brian Hayes Republican Nominated To NLRB
President Obama has nominated Republican Brian Hayes to the NLRB. As readers know, traditionally, the President's party holds 3 seats and other party holds 2. Workplace Prof Blog reports that now all 3 NLRB Members have been nominated (there are two remaining Members), the Senate may act on the nominations all at one time. On April 24, 2009, the President nominated two Democratic Members which the Senate has not acted upon. The NLRB Press release is available here. Hayes is a former management lawyer lawyer and currently is a Republican Senate staffer.
I have long been critical of the NLRB's nomination process. I do not see a need for the Board to be split. Additionally, it is time that the Board begin to operate like a real court and stop flip flopping when a new Administration comes to office. The problem of course, is how do you make the change-when the flip or the flop is in office??
