Employee Misclassification Protection Act Introduced
Senator Kennedy is still hard at work. On September 29, 2008, he introduced S. 3648. If enacted, this statute would amend the FLSA to provide for harsher employer penalties for misclassifying workers as independent contractors.
The Bill imposes a $10,000 penalty for each violation and requires that a web site in plain English be developed which includes wage and hours forms and states that employers may be subject to greater liability.
Something tells me that the Republicans in Congress are not going to like this.
